Payment and AutoPay

All maintenance & service clients are required to use AutoPay for payment. A working credit card must be kept on file, and charges will be automatically processed the same business date or the following business day for all services rendered. To ensure secure and timely payments, we only accept credit cards. Checks or ACH payments may be accepted on a case by case basis.

Statements and Fees

 Late Fee Schedule

Late fees will be applied based on the duration of the overdue payment as follows:

Example:
If a payment is 3 weeks late, a late fee of 5% will be applied to the outstanding amount.

If a credit card declines, service will be paused until payment is made. For any project over $1,000, a 3% credit card processing fee will be added. Accounts with unpaid balances for 45 days will be sent to collections.

Service Cancellation

You may cancel our service at any time, for any reason. Cancellations must be submitted via email to [email protected] or client portal at least 48 hours before your next scheduled service. Failure to notify within this period will result in charges for that service visit.

Upon receiving your cancellation request, a confirmation email will be sent to you to verify the process has been completed. If you do not receive this email, please contact us to avoid any misunderstandings.

Cancellation for landscape & irrigation installation services made 21 days prior to schedule start date will receive 100% refund of deposit amount, less any credit card processing fees and administration processing fee of $50.00. 

Cancellations made within 14-20 days prior to project start date, will incur a 15% cancellation fee, less any credit card & administration fee of $50.00. 

Cancellations made within 7-13 days prior to project start date will incur a 20% cancellation fee, less any credit card & administrative fee of $50.00. 

Cancellations made within 1-6 days of scheduled installation date may be non-refundable. 

Proposal Acceptance

If a proposal is more than $5,000, we require a 30% deposit to secure your schedule date. The second deposit of 30% is due the day of installation. The remaining balance will be due upon completion. 

If a proposal is less than $5,000, we require a 50% deposit to secure your schedule date. The remaining balance is due upon completion. 

Proposal acceptance of any recurring services with Cutting Edge will automatically renew at the end of the cycle. Cancellations of any service must be made in writing with a minimum of 48 hrs prior to next scheduled service visit to avoid any additional charges. 

Customer Responsibilities

Before your service day, please ensure the following:

  • All pets are indoors.
  • All gates are unlocked.
  • The yard is clear of toys, furniture, and hoses.
  • Please note: If our crew arrives and cannot access your yard or is unable to perform service due to these issues, your service may be skipped without a refund or adjustment in price. Our crews are careful to close gates, but we do not take responsibility for lost pets.
  • Notify the office of circumstances that would impact/interrupt your service, such as: New sod, New Plants or any other work being performed on your property. 

Irrigation Installation Prerequisites Disclaimer for General Contractors and Builders

Before any irrigation installation work can commence, the following conditions must be met:

  • The property must be at final grade.
  • Permanent power must be operational.
  • All flower beds must either be fully installed or clearly marked.
  • Permanent water supply must be connected and accessible.
  • All concrete work must be completed.
  • Pass-throughs must be installed and easily identifiable.
  • No other contractors should be working in the designated installation area.

Failure to meet these conditions may result in delays or additional costs.

Assumption of care

By engaging Cutting Edge Irrigation & Lawns, LLC for landscape services, the client acknowledges and agrees to the following:

  • Client Responsibility: The client assumes responsibility for the care, upkeep, and maintenance of all landscape installations (including but not limited to plants, trees, shrubs, turf, and hardscape) upon the completion of services, unless a separate maintenance agreement is executed between the client and Cutting Edge Irrigation & Lawns, LLC.
  • Environmental Factors: The client understands that environmental factors such as weather, pests, or disease may affect the long-term health of the landscape. Cutting Edge Irrigation & Lawns, LLC cannot be held liable for any damages or loss resulting from these uncontrollable factors.
  • Ongoing Maintenance: Unless otherwise specified in a written agreement, ongoing maintenance such as watering, fertilization, pruning, and pest control are the sole responsibility of the client. Cutting Edge Irrigation & Lawns, LLC offers separate maintenance services that may be contracted upon request.
  • Risk of Loss: Once the project is complete and final payment has been made, all risk of loss or damage to the landscape elements is transferred to the client. Cutting Edge Irrigation & Lawns, LLC disclaims any responsibility for damage or loss that occurs after this transfer unless it is directly caused by the negligence of Cutting Edge Irrigation & Lawns, LLC.
  • Third-Party Products and Materials: Any third-party products or materials recommended or used in the course of the landscaping project are subject to the manufacturer’s warranty. Cutting Edge Irrigation & Lawns, LLC is not responsible for the performance or longevity of third-party products.

By proceeding with landscape services, the client agrees to these terms and acknowledges that landscape care and maintenance are crucial to the long-term success of the project.

Force Majeure:

Contractor will have no liability to Owner, nor will Owner have any right to terminate this Contract or assert a claim of offset against any sums owed to Contractor hereunder, because of Contractor’s failure to perform any of its obligations in the Contract if the failure is due in part or in full to reasons beyond Contractor’s reasonable control, including without limitation, strikes, or other labor difficulties, inability to obtain necessary governmental permits and approvals, war, riot, mandatory or prohibitive injunction issued in connection with the civil insurrection, accidents, acts of God, and governmental preemption in connection with a national emergency (collectively referred to as “Force Majeure”). If Contractor fails to perform its obligations because of any reasons beyond Contractor’s reasonable control (including those enumerated above), the period for Contractor’s performance will be extended day for day for the duration of the cause of Contractor’s failure.

811 Disclaimer

Any items broken during trenching and excavation that are not marked by 811 (septic, drainage, existing sprinklers, etc.) can be repaired at the owner’s request for an hourly charge of $170.00 per hour plus materials.

Checklist:

  • Inclement Weather Policy
  • We try to maintain our schedule even during rainy conditions. If weather makes it impossible to mow your lawn, we will notify you via SMS or email, and your service will be rescheduled for the next available day. In cases where we must skip two consecutive days due to weather, we will resume service based on the earliest available slot.

Additional Services & Fees

Additional services such as excessive trimming, leaf clean-up, or heavy-duty weed removal will be billed separately at $85 per hour, per worker. A minimum charge of $85 applies.

To help you better understand when these additional charges may apply, here are some common scenarios:

  • Pause in service: After a significant pause in service, extra charges may apply if overgrowth or excessive debris requires extra time to manage.
  • Overgrown lawns: If grass or weeds are over 4 inches tall, extra charges may be added for bringing the property back to standard conditions.
  • Trimming and clean-up: Excessive trimming (beyond 15 minutes) or leaf removal that requires additional crew time will incur extra charges.

Re-Routing

Our service routes are reviewed annually for efficiency. If your service day needs to be moved to a different day of the week, you will be notified immediately. We cannot guarantee service on a specific day, but we will make every effort to maintain a consistent schedule.

Auto-Renewal Clause

Term and Automatic Renewal:
This Agreement shall commence on the Effective Date and remain in effect for an initial term of 12 Months (the “Initial Term”). Upon expiration of the Initial Term, this Agreement shall automatically renew for successive terms of 12 Months (each a “Renewal Term”) unless either party provides written notice of its intent not to renew at least 30 days prior to the end of the Initial Term or any Renewal Term.

Opt-In Consent:
By agreeing to this clause, the Client explicitly consents to the automatic renewal of this Agreement under the same terms and conditions, subject to any modifications as may be agreed in writing between the parties. The Client acknowledges and agrees that failure to provide notice of non-renewal constitutes consent to renewal.

Notification of Renewal:
The Company will provide written notification of the upcoming renewal, including any changes to pricing, terms, or conditions, no less than 30 days before the renewal date. This notification will serve as a reminder of the Client’s right to opt out of renewal.

Cancellation and Opt-Out:
Either party may cancel the Agreement at the conclusion of the Initial Term or any subsequent Renewal Term by providing written notice as specified in this Agreement. Cancellation requests submitted after the renewal date will be subject to the terms of the current Renewal Term.

Changes to Terms:
The Company reserves the right to update the terms of this Agreement for Renewal Terms. Any changes will be communicated to the Client in writing at least 30 days prior to the renewal date, and the Client may choose to opt out of renewal if the updated terms are not acceptable.

Acknowledgment of Responsibility:
The Client understands and agrees that it is their responsibility to track renewal dates and notify the Company of any decision not to renew. Failure to provide timely notice will result in the automatic renewal of this Agreement.

Mowing Schedule

We offer the following service options only:

  • Year-Round – Bi-Weekly: Every other week on the same day.
  • Year-Round – Weekly: Every week on the same day.
